Zoning Board of Appeals
July 18, 2007

The duly posted meeting of the ZBA convened at 7:35 p.m. in room 105C at the Norfolk Town Hall.
The members signed vouchers for expenses and consultant invoices.
Preview Application(s):
The Richmond Company filed an application on July 11, 2007 for two special permits in accordance with Sections F.7.e. and I.7.b. of the Norfolk Zoning Bylaws. Mr. Mark McKenzie from the Richmond Company was present to represent the applicant. The application was deemed to be complete by virtue of providing all necessary documents and filing fees. The site plan submitted was not stamped by a professional surveyor or engineer. The Board will require a stamped plan during the hearing process. It was noted that this parcel was the subject of a special permit for the exact same project many years ago. That special permit has since expired. The Board will ask the Department of Public Works Director, Butch Vito, to attend the hearing and offer his input on such issues as the traffic flows.
Mr. Garrity made the motion to accept the application of the Richmond Company and to schedule the public hearing to August 15, 2007 at 7:45 p.m. Mr. Simpson seconded the motion. The vote on the motion was unanimous.

The Board reviewed the business meeting minutes of June 20, 2007. Mr. Kulesza made the motion to accept the revised minutes of June 20, 2007. Ms. Flynn-Poppey seconded the motion. The vote on the motion was unanimous.
Conservation Commission Reviews:
1) Stop River Realty (161 Dedham Street) – Two memorandums from PSC, Inc. were forwarded to the Commission from the Planning Board.
Correspondences:
1) Letter from MassHousing, dated June 27, 2007 – final approval for Norfolk Airport 40B project.
2) Anderson Krieger correspondence
3) Attorney Richard Nylen – additional copies of special permit criteria regarding Pine Creek Development
4) PSC, Inc. – two construction observation reports for Norfolk Town Center Condominiums
5) Building Department correspondence re: 1 Cottage Court
6) Attorney Matthew Borrelli (dated July 12, 2007) re: Phase I, Norfolk Town Commons Project.
The Board discussed whether landscaping was proposed to be planted around the cell tower on Norfolk Town Center Condominium project. The Board will draft correspondence to the effect that no landscaping has been planted.
Ms. Flynn-Poppey reported that the Housing Appeals Court has determined that a town’s legal expenses related to the review of a 40B project cannot be paid by the applicant. The Board discussed that this matter should be taken into consideration during the next 40B proposal.
Ms. Flynn-Poppey reported on the issues discussed and voted at the recent Zoning Bylaw Study Committee. Ms. Flynn-Poppey announced that she would continue as the Zoning Board of Appeals representative to the end of her term.
The Board adjourned its business meeting at 9:50 p.m. to deliberate and vote on the Sprint Nextel request for special permit and the variance request for Maple Sands, Inc.
The Board closed the meeting at 10:30 p.m. at the conclusion of the vote for Maple Sands, Inc.
