Present: Bruce Simpson, John Burke, Robert Garrity, Lorraine Sweeney, Elissa, Flynn Poppey (8:05 p.m,.)

The duly posted meeting of the Zoning Board of Appeals convened at 7:35 p.m. in room 105C at the Norfolk Town Hall.
Applications:
Gregory Kay, D/B/A Shady Tree Landscaping – submitted on April 9, 2007 for an Appeal from the Building Inspector’s written determination of violations at 209 Dedham Street and a Special Permit in accordance with Section J.7.a.1.B to allow for the OUTDOOR STORAGE of more than one commercial vehicle. The locus is 209 Dedham Street. The applicant, Gregory Kay and Attorney Murphy were present. Mr. Simpson noted that the Appeal and the Special Permit are two separate issues with two application fees. A copy of the application was also submitted to the Building Commissioner. The applications were deemed to be complete for advertising. Mr. Burke made the motion to schedule the public hearing for the Appeal on May 16, 2007 at 7:45 p.m. Mr. Garrity seconded the
motion. The vote on the motion was unanimous. Mr. Garrity made the motion to schedule the public hearing for the Special Permit on May 16, 2007 at 7:47 p.m. Mr. Burke seconded the motion. A copy of the April 12, 2007 from the Building Commissioner was forwarded to Attorney Murphy.
Nancy Lancellotti – 23 Lake Street. Nancy Lancellotti was present. The application for a Special Permit in accordance with Section D.3.e of the Norfolk Zoning Bylaws was submitted on April 18, 2007. The application was deemed to be complete. Mr. Burke made the motion to schedule the public hearing to May 16, 2007 at 8:00 p.m. Mr. Garrity seconded the motion. The vote on the motion was unanimous.
The members signed vouchers for the month.
The Board adjourned the business meeting at 7:50 p.m. and opened the public hearing for Maple Sands, Inc. A full Board would not be in attendance until 8:05 p.m. Mr. Garrity made the motion to open the hearing and continue to 8:05 p.m. in order to have a full Board hear the variance request. Mr. Burke seconded the motion. The vote on the motion was unanimous.
The public hearing adjourned at 7:50 p.m. and the business meeting reconvened.
The March 21, 2007 business minutes were reviewed. Mr. Garrity made the motion to accept the minutes of March 21, 2007. Mrs. Sweeney seconded the motion. The vote on the motion was unanimous.

There were no conservation commission applications to review and comment.
Correspondence:
Correspondence was received from the Building Commissioner regarding 209 Dedham Street. Correspondence was also received from the Building Commissioner regarding the F.11.a findings at 224 Dedham Street. The Massachusetts Federation of Planning & Appeals Boards will be sponsoring a seminar on May 3, 2007 on Special Permits and Variances. Mr. Simpson stated that he would attend. The Building Commissioner sent correspondence to Bruce Johnston denying a building permit for 5 Franklin Avenue.

9:51 p.m. Pine Creek Development – continued to June 20, 2007 at 7:45 p.m.
9:52 p.m. Donald Skerry – continued to May 16, 2007 at 7:50 p.m.
Mrs. Flynn-Poppey gave an update on the matters before the Zoning Bylaw Study Committee.
The Board reviewed the e-mail correspondence from Attorney Daniel Hill regarding the proposed modification for Norfolk Airport, LLC. The modification of the 40B comprehensive permit revised the name of the applicant from Norfolk Landing, LLC to Norfolk Airport, LLC. Mr. Simpson made the motion to allow the modification to the Chapter 40B comprehensive permit. Mrs. Flynn-Poppey seconded the motion. The vote on the motion was unanimous.
The meeting closed at 10:30 p.m.
